POLICIES AND RULES

POLICIES

 

  1.  Restrictive rules will be those necessary to provide adequate security of property and to establish reasonable personal decorum at club activities and to establish safety guidance for all.

  2. Activities will be conducted without regard to sex or age except where safety of life or property is advisable.

  3. When an Active Voting Member dies his/her name will be added to the deceased Active Voting Member Plaque.

  4. Active Voting Members are defined as members who own property and a home in the park.

  5. Affiliate Members are defined as members who do not own a home or property in the park and are an annual member.

  6. Seasonal Members are defined as members who rent from an Active Voting Member for up to six (6) months.

  7. Applicants will have their dues prorated based on which month they apply.

  8. If a member fails to maintain their membership and wishes to reapply, they will be subjected to a new initiation/application fee and the application process.

  9. All club members are expected to abide by the Henderson Creek Club Bylaws, Policies, and Rules.  Failure to do so will result in the following:

  10.  1st offense: Verbal prompt to redirect member by fellow member or Board member,

  11. 2nd offense:  Written letter outlining the behavior,  corrective actions, and notification that suspension will occur if the member continues the behavior.

  12. 3rd offense: Period of suspension to be determined by the Board majority.

  13. 4th offense: For an Active Voting Member the Board will request that the Active Voting Membership begins the termination process per Bylaw Article III Section 4.  For Affiliate/Seasonal members a majority vote by the Board will terminate their membership per rule Section 3 #7.

  14. If the infraction is considered especially egregious the Board may determine it is essential that Steps 1-3 may be skipped for the Club or club members safety.

  15. The Camera at the club are there for security and safety purposes and the Board 

       will utilize them for that purpose.

 16. When an incident occurs upon request of a  Board  Member or Club Member    

       the cameras will be viewed by the President or his/her designees  and it will be 

      determined if further action is necessary. 

 17. The Board will have sole access to the cameras.    

 18. Should a member of the Board leave the access codes to the cameras will  

      be changed so that only current members are allowed to view the cameras.

 

RULES

Section 1  General

  1. If an Active Voting Member has a matter to be discussed at the Annual Meeting, it must be submitted in writing, signed and dated to the Board of Directors at least thirty-four (34) days prior to the date of the Annual Meeting.

  2. No Solicitation of funds from the membership for any new project shall be made unless first approved by the Board of Directors.

  3. All meetings will be conducted using Robert's Rules as a guide.

  4. No pets shall be permitted in club facilities with the exception of guide/handicap dogs.  Members embarking/disembarking from their boat may have their leashed dog in the yard only for the purpose of getting on and off their boat.

 

        Section 2 Membership

  1. Applications for membership must be approved by the Board of Directors.  

  2. Initiation/application fees, annual dues, boatyard dues, key fees and any other fees will be determined by the Board of Directors.

  3. On the sale of an Active Voting Members home and/or lot, the seller’s non-refundable dues can be used as an incentive to the buyer to become a club member of Henderson Creek Club Inc.  The buyer, with Board of Directors approval can become a member by paying the initiation fee and submitting to a background check.

  4. Children who inherit their parents property (who is an Active Voting Member) may apply to become a Club member.  They may request the initiation fee be waived.

  5. They will be required to pay for a background check and must have Board of Director approval to become a member.  

  6. Club and boatyard keys are the property of Henderson Creek Club, are not transferable, and must be returned for the key deposit.

  7. All new members (including transferred memberships) must pay a refundable deposit for club and boatyard keys.

  8. All new members shall be given a copy of the Bylaws, Policies and Rules or directed to read them on the club website.

  9. Active Voting Members who own multiple properties and wish to rent their properties seasonally must pay an annual fee for each property plus the monthly rental dues.  The Board of Directors will set the fee.

  10. Affiliate Members who purchase property in the park must apply to become an Active Voting Member and will be dealt with individually.

 

Section 3  Policies and Rules for Affiliate and Seasonal Memberships.

  1. The Spouse or Live in Partner of Affiliate/Social Member will have the same privileges as the member.  The Membership is not transferable for any reason.

  2. Applications for Affiliate Members and spouse/live-in partner shall consist of an application, application fee and will require a photo ID, Social Security number to conduct a background check. Club and Boatyard Membership will be determined by the Board of Directors.

  3. App[cations for Seasonal Members will be submitted by the home owner and includes Seasonal Application , photo ID, background check fee, and monthly rental fee(s).  Seasonal renters will be oriented by a designated member once they have passed the Board criteria for admission.

  4. Homeowners are responsible for orienting their renters to the HCC Bylaws, Policies and Rules.  If the renter fails to abide by them and does not respond to redirection, the Board reserves the right to terminate their membership.  Club fees will be nonrefundable.  The Board reserves the right to refuse any homeowner future rental application(s).

  5. Affiliate/Seasonal Members will have use of the boat docks and storage, if available for an annual fee.  Active Voting Members have priority based on space.  The Board of Directors will set the fees and the Boatyard committee will allocate spaces as they are available.

  6. The Affiliate/Seasonal Members MUST accompany/be present when any of their guests are on the property.

  7. Age for Affiliate/Seasonal Members will be 30 years or older as determined by the Board of Directors.

  8. New Affiliate Members fees are to be prorated from Jan.

  9. All Affiliate/Seasonal Members must abide by the Bylaws, Policies and Rules of Henderson Creek Club Inc.  Those not abiding could have their Membership canceled at any time by the majority of the Board of Directors, with loss of fees/dues.

  10. A refundable charge for club and boatyard keys will be determined by the Board of Directors.  In the event a member loses their key their key refundable charge is void and the replacement key charge will be set by the board.

  11. Affiliate/Seasonal Members may have only one (1) boatyard key but may purchase a second club key.  They Keys are the property of Henderson Creek Club Inc. and must be returned at the termination of the Affiliate/Seasonal Membership. 

  12. Application, dues, monthly membership fees, keys and any other fees will be determined by the Board of Directors.

  13. In the instance that a home is purchased and the owner will not be using it as their primary residence, any full time resident(s) (family or not) in the home must apply as Affiliate Members.  Effective for new applicants beginning 1/2020.

  14. There shall be a limit of 6 persons at the clubhouse/pool for any Affiliate/Seasonal member at any time. This would be two members and four guests, or one member and five guests. (effective 11/2023)

 

Section 4  Club Activities, Membership, Private Groups, and Non-Members

  1. Any Club Function must have Board of Directors approval.

  2. Members desiring to reserve the Hall shall submit a club application to the Board of Directors for approval.  The request must include all pertinent details regarding the activity planned.  The member is expected to have their guests comply with the Club policies and rules, assume responsibility for damage to any of the club property, and abide by the Club Usage Rules in the application.

  3. A member cannot be denied access to Club facility at any time However, if an approved and posted private party is being held, members should use other areas of the club facility.

  4. Club members are permitted to invite guests to all paid functions.  All attendees must have a member invitation to attend. Their attendance will be paid at the planned function rate determined by the Entertainment Committee. Non-members may not attend events designated as “Club Members Only”.

  5. Family members staying overnight in a members home when the member is not present may attend club paid functions and pay the members fee rate.

  6. Any Henderson Creek Park property owner or resident in a home (and is not an Affiliate Member) which does not have a Henderson Creek Club Inc Membership shall not have access to Club facilities. The exception being, they may be invited by a Club Member to Club paid functions and must pay the event fee as determined by the Entertainment Committee.  

  7. No person under the age of 18 will be permitted on Club premises after Pool hours unless accompanied by an eligible adult.

  8. All Club Members are directly responsible for all their guests while on Club premises.  Damages and injuries will be the responsibility of the Member.

  9. The proper procedure for the discussion and settling of grievances or problems concerning the Club is to contact the Board of Directors, either in writing or in person.

  10. The Club’s newsletter, email, and web site (“hendersoncreek.com”) are for the purpose of reporting Club activities, scheduling events, and other newsworthy items approved by the Board of Directors.

  11. Any permanent resident in the home of an Active Voting Member shall have no vote and shall not participate in any discussion at any meeting of the Henderson Creek Club.

  12. “Private” and “No Trespassing” signs shall be posted on the Club’s property.

  13. No vehicles, boats or trailers may be parked on the grass areas around the Club and Boatyard overnight.

 

Section 5 Tour of Duty and Building Security

  1. Tour of Duty period will be for one (1) week and duties will be outlined by the Tour of Duty Chairperson.

  2. The Tour of Duty Member or Members of the group using the hall will conduct a cleanliness and security check of the club each night.

  3. Members shall lock the Club doors and gates when leaving the Club area.

 

      Tour of Duty Tasks

  • Kitchen and Bathrooms:

  1. Check that the kitchen and bathrooms have paper towels and toilet tissue

  2.  Notify the Tour of Duty contact person when the Tour of Duty Supply Needs restocking

  3. Cleaning kitchen counters, kitchen and bathroom sinks, toilets, and showers as needed.

  4. Wipe down kitchen and bathroom floors as needed.

  • Main Hall:

  1. Vacuum or sweep thoroughly all floors, rugs, and edges in the main hall, library, and entryway at least once per week

  2.  Dust window sills as needed.

  3. High dust as needed

  4. Vacuum or sweep thoroughly all floors, rugs, and edges in the main hall, library, and entryway at least once per week.

  • Trash and Recycles

  1. Empty trash as needed in Green Top Bin.

  2. Empty recycles in Yellow Top Bin.

  3. Empty all trash into Green Top Bins on Sunday and Wednesday nights and put bins out for collection the next day.

  4. Empty all recycles into Yellow Top Bins on Wednesday night and put bins out for collection the next day.  

  5. Return bins on Monday and Thursday when the town has completed collections.

  • Pool, Pool Deck and Entry Way

  1. Once weekly, wipe down all tables in the pool area. 

  2. Once weekly, rinse down the pool deck.  (notify the Grounds Committee if the deck needs to be power washed.)

  3. Report any water level issues to the Grounds Committee.

  4. Water potted plants in front entry.

  • Security

  1. Each night check all doors are closed’

  2. Report any security concerns to the Board.

  3. Report any safety/maintenance issues to the Grounds Committee.

 

Section 6 Pool and Spa Rules

  Rules are posted near the pool and spa and shall be observed by all Members and guests. Swim at your own risk, there are no lifeguards on duty.All County and State Government rules concerning usage of the pool and spa shall be considered part of the rule section

  1. Covers are to be removed fully before using the pool or spa.

  2. Access to the pool and spa by swimmers is to be by the gate only.  Gates are to be locked at all times.

  3.  An individual over the age of eighteen (18) must accompany children under fifteen(15). 

  4. No person under fifteen (15) is permitted in the spa.

  5. All new members will be given a copy of the rules or directed to read them on the Club web site.

  6. Pool hours are dawn to dusk.  No night swimming is allowed.  The pool may be closed during a Club function by vote of the Board of Directors.

  7. Shower each time before entering the pool or spa to remove oils and lotions.

  8. Soap and shampoos are not to be used in the outside shower.

  9. Follow arrows outside the Clubhouse to access bathrooms.

  10. No food or drink is allowed within four (4) feet of the pool or spa.  No items/containers made of glass are allowed on the pool deck.

  11. No smoking or e-cigarettes  are allowed in the pool deck area.  Smokers shall be directed to the Club designated smoking area.

  12. Keep the pool, spa, and deck area clean.

  13. Persons with open sores or skin disease must not enter a pool or spa.

  14. Pool floating devices, toys and safety aids should only be used with consideration of other swimmers.

  15. Swimsuits are to be worn.

  16. NO running, diving, jumping, horseplay in pool, spa, and deck area.

  17. Members and guests shall be respectful of their noise and music levels to not disturb others. 

  18. No pets are allowed in the area.

  19. Maximum spa temperature is 104 degrees

  20. Maximum bathers load in spa is eight (8).

  21. Consult a Physician before using the spa.

  22. Spa time limit is fifteen (15) minutes.

 

Section 7 Boatyard Rules and Regulations

  1. The Henderson Creek Club boating Facility  (which includes overnight slip/docking storage) is for Members, their spouses, and/or any permanent resident in a Member’s household. 

  2. Any Member using the boating facility must submit a signed HCC Boating Facility Use Agreement to the Board of Directors for approval.  

  3. A member's watercraft must be titled in the member's name.

  4. All watercraft must have a current Florida (or out of state) vessel registration sticker.

  5. Any watercraft with a sticker more than one (1) year old must be removed from the boat facility.

  6. An approved agreement does not ensure the member that there will be storage or mooring space available.  

  7. Member launching is always available as long as the trailer is removed from sight while the water craft is in the water.

  8. A Member may also register a second boat for day use only, utilize the ramp for that watercraft, but will not be able to use overnight mooring or storage.

  9. All unattended vehicles are to be removed from the boatyard.  

  10. Other watercraft such as wave runners, canoes, and kayaks may have two watercraft per trailer. 

  11. Do not block other watercraft,other trailers, the ramp, the gate, or the mailbox at any time, unless actively launching a watercraft, washing the watercraft/trailer, or repairing watercraft equipment.

  12. Watercraft launching will be for Members only (not guests or family not residing in the home).

  13. A Member may bring any eligible guest through the boatyard to board the Members boat or lend assistance.  

  14. Ineligible guests are property owners or renters in Henderson Creek Park without Henderson Creek Club Membership.

  15. The Board, at its discretion, upon notice to the member, may have any watercraft/trailer removed from the Henderson Creek Club boating facility, if the Member is not following the Henderson Creek Club published Bylaws, Policies & Rules and the boating use agreement.

  16. Any Member requesting any exceptions to the Henderson Creek Club rule in Section 7 must submit a written request to the Boatyard Chair for approval by the Board of Directors.  Exceptions will only be granted for a short period of time and are not precedent setting.

  17. The fee for boat/docking storage (which includes boat and trailer storage) shall be a yearly fee.  Slips may be used for short term mooring but not on a permanent basis.  Maximum use for mooring can not exceed more than 5 days.  (Effective Nov. 1st 2021) 

  18. There will be no fee to ramp a Members boat and take it home along with their trailer.

  19. Storage money accrued from Boatyard Members will go into a Boatyard Fund to be USED ONLY for boatyard maintenance, dock repair, striping, cleanup, or anything to do with the boatyard facility.  

  20. The Boatyard Fund will be only for the boatyard until all docks are repaired.  Including docks bordering Henderson Creek and Boatyard Storage area.  Once this is completed, any excess monies over the set reserve fund of $50,000 will go into the General Fund.  This may take years to happen.

  21. The Boatyard Fund will be held for future dock repair/maintenance and or other improvements of the Boatyard.

  22. All Members using the boating facility (storing and/or launching a boat) must show proof of a current boat insurance policy.  This policy needs to only cover liability and property damage.

  23. Any boat or trailer that has not been moved in a year, must be removed .

  24. Boats and trailers must be maintained and kept clean.

  25. The slip closest to the ramp should be left open for use in loading and unloading.  Only Boatyard Members can leave their boats in the remaining 6 slips overnight.  (Please see #17 regarding 5 day maximum)

  26. Boatyard Members must always store their trailers and boats in their assigned spaces.  (assignment Board is posted on the bulletin board in club hallway)

  27. Affiliate members coming from outside the park please use 1 parking spot only.  Carpooling your guests is required due to the limited parking.  All other members please leave tow vehicles at home.

  28. THE BOATYARD GATE MUST BE CLOSED AT ALL TIMES.

  29. A Boatyard waiting list will be maintained by the Boatyard Committee Chairperson(s).  Active Members will be given priority on a first come first serve basis.
